Earned settlement: where things stand in November 2026

The proposal to make 10 years the standard wait for settlement in the UK is the biggest open question for anyone planning a long-term move. Here is the position at the start of November 2026.

What is proposed

The government has consulted on “earned settlement”: a 10-year baseline qualifying period for indefinite leave to remain, which people could shorten through contribution. Proposals in the consultation include reductions for people earning above the higher and additional rate income tax thresholds.

What is actually in force

Nothing yet. The 5-year routes to settlement remain open, and the faster routes, such as Innovator Founder, are unchanged.

When it could change

In September 2026 the Home Secretary told the Home Affairs Committee that the policy would be set out later in 2026. Changes will come through a Statement of Changes to the Immigration Rules, which is normally published at least 21 days before it takes effect. Whether people already on a route will be protected by transitional rules has not been decided.

What to do now

  • If you are eligible to apply for settlement, consider applying without delay.
  • Check your absences with our absence calculator.
  • If you are choosing a route, compare how quickly each leads to settlement.

We will update this page, and our settlement guide, as soon as the rules are published.
